About these terms

These Terms govern your use of elephantscapital.com and related applications, calls and messages (the "Services") offered by Elephants Capital LLC. By using the Services you agree to these Terms and our Privacy Policy.

What we do

Elephants Capital helps businesses and real estate investors find financing through a network of funding partners. Submitting an inquiry or application is not an offer or a commitment to provide financing. Approval, amounts, rates and terms are set by the funding source after underwriting and are described in the documents you sign. A merchant cash advance is a purchase of future receivables, not a loan.

Business purpose only

The Services are for business purposes. You must be at least 18 and authorized to act for the business you apply for. Our real estate programs are business-purpose loans on non-owner-occupied investment property; we do not arrange consumer loans or loans secured by your primary residence.

Information you provide

You agree that the information you submit is true and complete, and you authorize us and our funding partners to verify it, including by obtaining credit, background and bank information under the authorization in your application.

Calls and text messages

Program: Elephants Capital funding updates, which are messages about your inquiry, application status, document requests, offers and renewals.

By opting in, you agree to receive calls and texts at the number you provided, including messages sent with automated technology or a prerecorded or artificial voice. Consent is not a condition of any purchase or funding.

Message frequency varies. Message and data rates may apply. Reply STOP to cancel; you will receive one confirmation message. Reply HELP for help or call (321) 294-0413. Carriers are not liable for delayed or undelivered messages.

Offers from funding partners

Offers come from funding partners and are governed by their own agreements. We are not responsible for a funding partner's decisions, products or conduct.

No advice

Information on the site is general and is not legal, tax, accounting or investment advice.

Acceptable use

Do not misuse the Services: no false applications, unauthorized access, scraping or interference, and no use that violates the law.

Intellectual property

Site content, logos and the Elephants Capital name belong to us or our licensors and may not be used without permission.

Limitation of liability

To the extent permitted by law, Elephants Capital is not liable for indirect, incidental, special or consequential damages arising from your use of the Services.
